基因技术的专利保护与利益分享

1990年时以之为基础的制药工业已经价值30亿美圆。Moore向法院提起诉讼，指控GOLDE等the tort of conversion。上诉法院认为医疗机构没有充分告诉有关信息，侵犯MOORE的隐私权，该细胞群应该归Moore所有，而加州最高法院则认为归大学所有。本案事实上是一个政策决定（A Policy Decision),因为法院清楚，如果细胞群判归MOORE所有，那么此类重要的医学研究将遭受重大打击。有关本案的评论请见Hilary Newiss at 49；
